Shane Delsman focuses his intellectual property law practice primarily on litigation, particularly on behalf of plaintiffs, in trademark, unfair competition, and patent lawsuits. He applies his broad strengths in all areas of IP law to the special needs of start-ups and other companies, helping them to build and protect their IP portfolios.

Shane has advised clients regarding products focused on mechanical technologies ranging from large agricultural equipment to accessories for motorcycles, and on electrical and electronic applications, in areas as diverse as radio frequency electronics and encryption and hand and power tools. Shane counsels clients on patent prosecution and opinions, and he advances client interests through their participation in and compliance with standard-setting organizations.

An active member of the Chicago Bar Association (currently as Chair of the Intellectual Property Law Committee), the Richard Linn American Inn of Court, and the Chicago Intellectual Property Alliance (CIPA) Mentorship Program, Shane regularly makes presentations on topics related to intellectual property and litigation.



Shane Delsman was an integral member of the litigation team for the following matters:

Transcenic Inc. v. Google Inc., Microsoft Corp., AOL Inc. & MapQuest Inc.(D. Del. 2011). Represents the plaintiff in a patent infringement action related to online mapping applications.

Chamberlain Group, Inc. v. GMI Holdings, Inc. and Overhead Door Corp. (N.D. Ill. 2011). Represented the plaintiff in a patent infringement action involving obstruction-sensing systems for garage doors. Settlement was reached.

Chamberlain Group, Inc. v. Decko Products, a division of Michel Sales Company and Guardian Access Corporation (N.D. Ill. 2010). Represented the plaintiff in a patent infringement action involving garage door positioning systems. Settlement was reached.

Deere & Company v. Great Plains Manufacturing, Inc. (S.D. Iowa 2010). Represented the plaintiff in a patent infringement action involving the design of agricultural seed tubes. Settlement was reached.

Deere & Company v. Bush Hog, LLC and Great Plains Manufacturing, Inc. (S.D. Iowa 2009). Representing the plaintiff in a patent infringement action involving the design of pull-behind rotary cutters. Case is pending.

McDavid Knee Guard, Inc. et al. v. Nike USA, Inc. (N.D. Ill. 2008). Represents the plaintiffs in a patent infringement action related to protective athletic apparel.

WMH Tool Group, Inc. v. Woodstock International, Inc. and Grizzly Industrial, Inc. (N.D. Ill. 2007). Represented the plaintiff in a trade dress infringement action related to color in woodworking and metalworking tools. Settlement was reached.

Chamberlain Group, Inc. and Johnson Controls Interiors LLC. v. Lear Corp. (N.D. Ill. 2005). Represented the plaintiff in a patent infringement action involving a rolling code encryption system for use with garage door openers. Settlement was reached.
