The U.S. Supreme Court has granted certiorari in WildTangent, Inc. v. Ultramercial, LLC, et al., and has instructed the Court of Appeals for the Federal Circuit to revisit its WildTangent decision in light of the Court's holding in Mayo Collaborative Services v. Prometheus Laboratories, Inc. The issue in the WildTangent case is whether a process claim that specifies certain steps performed "over the Internet" or "at an Internet website" can constitute statutory subject matter under 35 U.S.C. 101.
Earlier this year, the Court similarly remanded Association for Molecular Pathology et al. v. Myriad Genetics, Inc., et al. in light of the Mayo decision.
