IP Alert: Supreme Court Decides Already LLC v. Nike, Inc.

Today the United States Supreme Court issued its decision on Already LLC v. Nike, Inc. This case addresses whether a covenant not to sue divested the federal courts of Article III jurisdiction. The Court held that, on the facts before it, the covenant not to sue was effective to render moot the underlying controversy between the parties.
