Fitch Even partner Stephen Favakeh presented a seminar for the Institute of Intellectual Property (IIP) in Tokyo, Japan on January 22, 2010. The presentation, "The Best Defense is a Good Offense: Patent Reexamniation" addressed the increasing use of Reexaminations by accused infringers to attempt to stay litigation while the PTO determines the validity and proper scope of challenged patent claims. Mr. Favakeh discussed the important strategic considerations faced by patent litigants in the United States with the use of Reexaminations and provided insights regarding the prosecution and defense of Reexamination proceedings.
