Fitch Even Client Sunny Fresh Foods Inc. Obtains Jury Verdict Of Non-Infringement

August 7, 2003

On August 7, 2003, a jury in the United States District Court for the District of Minnesota delivered a verdict finding that Sunny Fresh Foods, a Cargill company, does not infringe any of the claims of four patents asserted against it by Michael Foods, Inc. and North Carolina State University. The patents relate to the pasteurization of liquid egg products. The ruling is a major victory in a complicated matter that originally started with Sunny Fresh's request for a declaratory judgment of non-infringement in 1992.

Fitch Even attorney Steve Schroer led the trial team for Sunny Fresh, which also included partners Tim Levstik, Phil Petti and Tim Maloney, together with associate Mark Borsos.
