Software
Fitch, Even, Tabin & Flannery® assists clients in protecting their computer software advances through the use of copyrights, patents and trade secrets. Attorneys in this practice area have degrees in computer science and electrical engineering, and have experience with a wide range of software technologies.
We have helped protect technologies involving networking, system and application software, digital imaging, user interfaces, communications, industrial controls, artificial intelligence, application management software, and many others. We also have experience drafting a variety of software development, distribution, testing and license agreements, as well as source code escrow agreements.
FETF is also frequently retained to enforce and defend against patent rights in software technologies. One of the firm's victories in this area, Arrythmia Research Technology, Inc. v. Corazonix Corp. (Fed. Cir. 1992), helped open the door to the use of patents to protect software inventions. In that case, the Federal Circuit rejected an infringer's challenge and recognized the patentability of a software based mathematical method used in monitoring a patient's heart. In recent years, we successfully managed broad patent enforcement litigation in the security system, software distribution, application integration and financial analysis industries.
