Today the U.S. Patent and Trademark Office (USPTO) published proposed rules of practice to implement the supplemental examination provisions of the America Invents Act. The USPTO also proposed adjusting the fee for filing a request for ex parte reexamination and setting a fee for petitions filed in ex parte and inter partes reexamination proceedings.
Publication of these proposals puts into effect a 60-day public comment period, during which the public may provide written feedback on the proposals to the USPTO.
Fitch Even will provide additional information regarding the proposals in an upcoming alert.
