Today, in POM Wonderful LLC v. Coca-Cola Co., the U.S. Supreme Court held that beverage company POM Wonderful may maintain a Lanham Act suit against Coca-Cola over alleged misleading juice labeling. The decision reverses the Ninth Circuit’s ruling that another federal statute, the Federal Food, Drug, and Cosmetic Act, precludes Lanham Act challenges.
