IP Alert UPDATE: Supreme Court to Hear Iancu v. NantKwest

UPDATE: Today the U.S. Supreme Court granted the government’s petition for a writ of certiorari in Iancu v. NantKwest, a case discussed in our earlier alert here. The Court will consider the following question: “Whether the phrase ‘[a]ll the expenses of the proceedings’ in 35 U.S.C. § 145 encompasses the personnel expenses the United States Patent and Trademark Office incurs when its employees, including attorneys, defend the agency in Section 145 litigation."
Fitch Even attorneys will monitor the progress of this case and report once the Court has reached a decision on this question.
