Alexsam, Inc. Obtains Favorable Patent Claim Construction Ruling

Fitch Even client, Alexsam, Inc., obtained a favorable patent claim construction decision in its patent infringement lawsuit against IDT Corporation, which is pending before the Honorable T. John Ward in the United States District Court for the Eastern District of Texas.

Alexsam contends in this lawsuit that IDT infringes U.S. Patent Nos. 6,000,608 and 6,189,787, which relate to systems and methods for conducting electronic transactions associated with various types of stored value cards. At issue are several IDT gift card, phone card and pre-paid debit card products. IDT raised several issues of patent claim interpretation in defense to the alleged infringement. After receiving briefing and conducting a Markman Claim Construction Hearing, Judge Ward issued a Memorandum and Opinion Order dated June 29, 2010. The Court’s Order construed the patent claims almost entirely as proposed by Alexsam. The Court adopted eight of Alexsam’s proposed constructions verbatim and made only slight modifications to Alexsam’s proposed constructions of the remaining three disputed claim terms.

The case is scheduled for jury trial in November of this year.
