Waters Industries Resolves Lighted Reading Glasses Patent Infringement Lawsuits

April 15, 2010

Waters Industries Inc., through its Panther Vision LLC division, is a leading provider of innovative LED task-lighting solutions for consumers and businesses. Panther Vision’s product line includes LED lighted hats, reading glasses safety glasses and clip-on lights, among other unique products.

Waters Industries has relied on Fitch Even for many years to obtain strong patents to protect its innovations in these and other product areas and technologies. The company recently called on the firm’s litigation practice to lead efforts to enforce several of its lighted reading glasses patents against companies believed to be selling infringing products. Three patent infringement lawsuits were recently pursued in the United States District Court for the Northern District of Illinois to enforce U.S. Patent No. 6,612,695, 6,863,416, 7,104,670 and 7,377,664. These suits sought to enjoin the unlicensed use of the company’s intellectual property by providers and resellers of lighted reading glasses including AJ Morgan, Peppers Performance Eyeware, Lillian Vernon, QVC, Mr. Christmas, Inc., For Your Ease Only, Hammacher Schlemmer and The Gerson Company.

We are pleased to report that each of these lawsuits has been resolved and dismissed pursuant to settlement and license agreements obtained by Waters Industries.

Waters Industries was represented in the litigation by Fitch Even attorneys Tim Maloney, Steve Schroer, Mark Borsos and Calista Mitchell. Fitch Even partner Steve Favakeh has been instrumental in Waters Industries’ patent strategy and patent portfolio building initiatives.
