Job Title: Senior Trademark Associate

Position Summary
Fitch Even is seeking an experienced Senior Trademark Associate to join our trademark practice in Chicago. This is an excellent opportunity for an attorney who enjoys substantive, varied trademark work and wants to take on meaningful client responsibility within a collegial, well-established IP firm. The role will also involve some copyright and IP agreement responsibilities. You’ll work closely with partners and play an important role in a growing practice group that serves a sophisticated domestic and international client base.
Essential Duties and Responsibilities
- Play a key role in managing a diverse portfolio of domestic and international trademark matters, including clearance, prosecution, and enforcement.
- Develop and execute prosecution strategies, including overcoming likelihood-of-confusion and other refusals.
- Perform trademark clearance searches and assessments.
- Assess copyrightability, prepare and prosecute copyright applications, and advise on copyright issues.
- Advise clients on brand launches, enforcement strategy, coexistence and settlement negotiations, and related commercial issues.
- Prepare and advise clients regarding commercial agreements that relate to intellectual property, such as non-disclosure agreements, joint development agreements, influencer agreements, and license agreements.
- Handle enforcement matters ranging from cease-and-desist strategy through TTAB proceedings and, where appropriate, federal court.
- Collaborate with international counsel on cross-border trademark strategy, filings, and enforcement.
- Contribute to the mentoring of associates and paralegals and to the ongoing work of the practice group.
Qualifications
- 5+ years of substantive trademark experience at a law firm or in-house.
- Strong background in trademark prosecution and enforcement, including TTAB and/or federal court experience; copyright and IP transactional experience a plus.
- A self-motivated, proactive approach to management of matters.
- Experience with international trademark portfolios and coordinating with foreign associates.
- Excellent writing skills, client-communication skills, and a practical, business-minded approach.
- A collaborative working style and creative approach to problem solving.
- Admission to the Illinois bar (or eligibility to waive in) in good standing.
This position will be based in our Chicago office. At this time, employees are required to be in the office two days per week.
Salaries vary by location and are based on numerous factors, including, but not limited to, the relevant market, skills, experience, and education of the selected candidate. The target salary range for this role is below. Our compensation package also includes bonus eligibility and a comprehensive benefits program as outlined below.
