This Privacy Policy applies to the website and online services offered by Fitch, Even, Tabin & Flannery LLP (“Fitch Even”) through the domain fitcheven.com, including any mobile application or version of the site (collectively, the “Site”). It explains the types of information collected through the Site and how such information may be processed, used, or shared. By using the Site, you, the user, agree to the terms of this Privacy Policy. If you do not agree with this Privacy Policy, you must discontinue using the Site.
Collection of Personal Information
Users may browse the portions of the Site that do not require the entry of login credentials without registration and without actively entering personally identifying information. However, certain information may be provided automatically by the user’s web browser or application when entering or using the Site, including, e.g., IP addresses, hardware model, other device identifiers, browser type, operating system, access dates and times, referring and exiting URLs, and other log information. Fitch Even will not treat automatically-collected information (log information) as personal information.
Users may be asked to provide personal information in certain areas of the Site, such as when completing forms on various webpages, including certain third-party services and webpages linked to the Site. This may include providing personal information (e.g., user’s name, organization, phone number, email address, bar admissions, MCLE certificate requests, legal interest areas, etc.) to register to receive Fitch Even’s client alerts, webinar invitations, and other information, or to register for Fitch Even events. Fitch Even will use the personal information collected via the Site for the purposes for which it was provided, as well as for other purposes consented to by the user.
Users who register with the Site may be informed about client alerts, webinars, events, or other materials or activities. Users may opt out of receiving such communications by sending requests to info@fitcheven.com.
Note that our servers are either located in the United States or, if located in the European Economic Area (EEA) or in Switzerland, data may be replicated to servers in the United States.
Fitch Even may also collect personal information when users request legal advice or representation for themselves or their employer or subscribe to our social media content or email lists, visit our offices or meet with us, correspond or communicate with us, network with us at an event, provide or offer to provide services or goods to us, or send us your resume, apply for employment, or attend a job interview.
Fitch Even may use personal information for purposes of providing professional services, relationship support, marketing communications, compliance with laws, or for other lawful purposes.
Fitch Even uses service providers, e.g., Google Analytics™, that may collect and utilize personal information via the Site or third-party sites, and their collection and use is governed by their respective privacy policies.
Use of Cookies
A cookie is a small data file that a website saves on your computer or mobile device when you visit the site. Fitch Even does not use cookies for advertising purposes. However, Fitch Even uses third-party services (such as Google Analytics) that are automatically accessed when the user loads webpages on the Site that may use cookies, and their use is governed by their respective cookie policies. Certain pages of the Site may contain “web beacons” (also known as internet tags, pixel tags, and clear GIFs). These web beacons allow Fitch Even or third parties to obtain information such as the IP address of the computer that downloaded the page on which the beacon appears, the URL of the page on which the beacon appears, the time the page containing the beacon was viewed, and the type of browser used to view the page.
Do Not Track Requests
The Site does not currently recognize browser “Do Not Track” requests. Users may, however, disable certain tracking by disabling cookies.
Transfer of Personal Information
Fitch Even has offices across the United States, with clients and foreign associates located throughout the world, including in the EEA and in Switzerland. Fitch Even may, from time to time, transfer personal information to its foreign associates or to other agents, representatives, or contractors providing services to Fitch Even or our clients. Any such transfers to agents and contractors are solely for the purposes of providing services to Fitch Even and its clients. Some such transfers may be overseas, which may include transfers to countries outside of the EEA or Switzerland whose laws provide levels of protection for personal information that are not always equivalent to the level of protection that may be provided in the user’s own country. Fitch Even reserves the right to transfer any information about users when Fitch Even or any affiliate sells or transfers all or a portion of its business or assets.
Fitch Even may engage third-party companies and individuals to perform services on our behalf, including, without limitation, to facilitate our website, provide the website on our behalf, and perform website-related services (e.g., maintenance, database management, website analytics, and improvement of the website’s features) or to assist us in analyzing how our website is used. These third parties may have access to your automatically collected information and personal information provided via the Site. These service providers are not authorized by Fitch Even to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements, except that automatically collected information (e.g., IP addresses, hardware model, other device identifiers, browser types, operating systems, access dates and times, referring and exiting URLs) may be used by these service providers for any purposes authorized under our agreements with these service providers.
Security Procedures
Fitch Even maintains appropriate technical and organizational security procedures in order to keep users’ personal information confidential and protect such information against loss, misuse, unauthorized access, disclosure, or alteration, in accordance with applicable data protection and privacy laws. However, Fitch Even cannot ensure or warrant the security or confidentiality of automatically collected information or personal information provided via the Site.
In addition, Fitch Even maintains confidentiality policies that govern all information that any attorneys or other personnel of Fitch Even receive in their employment or association with Fitch Even. All attorneys and personnel are informed of these policies, and Fitch Even has in place procedures to train all attorneys and personnel in the implementation of these policies.
Third-Party Links
The Site may contain hyperlinks to websites of third parties. Fitch Even does not take any responsibility for the third-party content or compliance of the third-party website with data privacy laws. This Privacy Policy does not apply to such third-party content or sites. Users are encouraged to review applicable privacy laws and policies before submitting personal information to third-party websites. Fitch Even cannot undertake any obligation to review or ensure enforcement or compliance with or of the privacy policy of any website to which we link.
Fitch Even employs third parties to broadcast its webinars and to deliver certain email communications. We do not take any responsibility for compliance of these third parties’ websites with data privacy laws.
Children’s Privacy
Fitch Even does not knowingly collect, use, or disclose personal information from children under the age of 13. If Fitch Even is made aware that it has collected personal information from a child under 13 years old in a manner that is inconsistent with the Children’s Online Privacy Protection Act, Fitch Even will delete this information as soon as possible.
Revisions to this Privacy Policy
Fitch Even reserves the right to change or amend this Privacy Policy at any time without prior notice, whereby relevant changes take effect for the future. Any change or update to the Privacy Policy will be posted on this website with the effective date noted at the top of this page. The applicable version of this privacy policy is available on the Site. Users are encouraged to check this Privacy Policy regularly, and before submitting additional personal information via the Site. A user’s continued use of the Site after any modification to the Privacy Policy will constitute the user’s acceptance of the new terms. If the user does not agree to changes to this Privacy Policy, the user must stop using the site after the effective date of such changes.
