IP Alert: Supreme Court Grants Certiorari in Four Key Cases

Today the U.S. Supreme Court granted writs of certiorari in Limelight Networks, Inc. v. Akamai Technologies, Inc., discussed in our previous alert here, and in Nautilus Inc. v. Biosig Instruments, Inc. The Limelight case concerns the issue of induced patent infringement under 35 U.S.C. 271(b), while the Nautilus case concerns the standards for holding a patent claim indefinite under 35 U.S.C. 112.

The Court also granted writs of certiorari in ABC, Inc. v. Aereo, Inc. and in POM Wonderful LLC v. The Coca-Cola Co. The Aereo case addresses the issue of when an Internet transmission qualifies as a "public performance" under the copyright laws, while the POM Wonderful case addresses an issue of standing under the Lanham Act.
