Fitch Even partner Joseph T. Nabor was quoted in an article published online in today’s edition of EcommerceBytes, a leading source of news for ecommerce and online merchants. The article, "Is Amazon Handmade Overreaching on Artisan Terms of Use?," reports on the concerns some artisans have regarding the Terms of Use (TOU) they must agree to when selling their products on such online marketplaces as Amazon and Etsy.
In the article, Joe addresses the concerns these sellers have and the reasons companies need to require them to enter into such agreements, explaining that the TOUs are necessary for the companies to properly operate their marketplaces. Still, he points out, sellers “have to look at the full legal ramifications of accepting these agreements." He goes on to suggest how marketplace operators can narrow the scope of the language so that the agreements are fairer to all, and how artisans can help protect themselves in the meantime.
