Two IP litigation updates written by Fitch Even partner Joseph F. Marinelli are featured in the March 2018 issue of Business Law Today, published by the ABA Business Law Section.
In the first briefing, “Patent Office Panel Rejects Tribal Sovereign Immunity Claim in Inter Partes Review,” Joe reports on the recent PTAB ruling in Mylan Pharm. v. Saint Regis Mohawk Tribe. His second piece, “Federal Circuit Affirms Eligibility of Exergen Thermometer Patents,” focuses on Exergen Corp. v. Kaz USA, Inc., in which the Federal Circuit affirmed a lower court’s finding that Exergen’s forehead thermometer patents were not invalid for claiming laws of nature.

Today, in United States Patent and Trademark Office et al. v. Booking.com, the Supreme Court held that a generic word can be granted trademark protection when it is part of a ".com" domain name, ruling in favor of Booking.com in its petition to trademark its name. Read more
